STJ: waiver-of-improvements clause also covers new constructions built by the tenant

By a 3-2 vote, the 4th Panel of the Superior Court of Justice (STJ) held that a lease clause waiving compensation for improvements also covers accessions, i.e., new buildings erected by the tenant. The prevailing opinion of Justice Isabel Gallotti found that, since the lease concerned vacant land, the parties’ true intention was to allow constructions with no right to indemnification (REsp 1,899,963).
