Digital and criminal law specialists point to a gap in Brazilian law regarding criminal liability for producing and sharing AI-generated sexual or degrading content targeting adults. While specific rules exist for electoral matters and for children and adolescents (Law 15,487/2026), Article 218-C of the Criminal Code did not replicate the “montage” provision of Article 216-B, leaving room for divergent judicial interpretations.
