In Special Appeal No. 1,899,963, the 4th Panel of the Superior Court of Justice held that a contractual waiver of indemnification for improvements in a real estate lease also covers accessions — i.e., new constructions erected on the property. The ruling reinforces the prevalence of freedom of contract in commercial lease agreements.
