Brazilian Supreme Court upholds rule barring habitual debtors from judicial reorganization

The Brazilian Supreme Court (STF) upheld a provision of the Taxpayer’s Defense Code allowing companies classified as habitual debtors to be barred from entering or remaining in judicial reorganization proceedings. The rule also allows the Public Treasury to request conversion of the reorganization into bankruptcy, directly affecting corporate restructuring strategy.
