Oil royalties remain under judicial review

The STF is resuming the judgment of the long-standing dispute over the redistribution of oil royalties, involving the constitutionality of Law No. 12,734/2012 and its impact on producing and non-producing states.

At the same time, ANP recently distributed R$ 4.9 billion in royalties related to February 2026 production under production sharing contracts, showing the continued fiscal relevance of offshore production.

Market Impact

The outcome may influence:

  • fiscal planning for producing states and municipalities
  • legal certainty around oil revenue allocation
  • political and regulatory debates involving offshore production

Legal & Regulatory Implications

Companies should monitor whether the decision affects broader discussions around government take, fiscal stability and the legal environment for upstream investments.
