The CNPE has established the framework for auctions of natural gas belonging to the Federal Government under pre-salt production sharing contracts, providing greater clarity on pricing, eligible consumers and commercialization structures.
The rules distinguish between short-term auctions, with deliveries through 2030, and longer-term structural auctions aimed principally at creating additional demand from base industries.
Industrial consumers remain central to the policy. In the long-term auctions, access to the Union’s gas will depend on the creation of new demand, whether through new projects or proportional expansion of existing industrial capacity.
The framework also allows other domestic and imported gas suppliers — and, in certain cases, biomethane suppliers — to participate alongside the Union’s volumes, potentially transforming the auctions into broader mechanisms for matching supply and demand.
Market Impact
The new framework may:
- increase gas availability for fertilizers, chemicals, petrochemicals and steel production
- introduce additional suppliers into auction-based commercialization
- improve price transparency in Brazil’s natural gas market
- stimulate new industrial projects anchored by long-term gas supply
- create opportunities for traders, infrastructure operators and industrial consumers
- support the development of a more liquid spot market through PPSA sales
The commercial viability of the model, however, will depend not only on the price of the gas molecule but also on the costs of gathering, processing and transportation.
Legal & Contractual Implications
Market participants should assess:
- auction qualification and eligibility requirements
- firm, interruptible and flexible gas supply structures
- pricing formulas and international indexation mechanisms
- processing, gathering and transportation arrangements
- minimum purchase and demand commitments
- balancing, nomination and delivery obligations
- credit support and payment security
- infrastructure access and capacity allocation
- interaction between PPSA, Petrobras and other suppliers
For industrial consumers, long-term commitments should be assessed together with infrastructure availability, project implementation schedules and the economic assumptions supporting new or expanded facilities.
