The Superior Court of Justice (STJ) held that a subrogated insurer is not bound by an arbitration clause contained in a contract it neither entered into nor was aware of. According to the Court, under broad commercial insurance policies it cannot be presumed that the insurer knows every contract signed by the insured, redefining the reach of arbitration in complex contractual chains.
