The Federal Court of São Paulo granted an urgent injunction suspending infraction notices and fines imposed by ANTT on Bombril and BB Logística for non-compliance with the minimum freight floor established by Provisional Measure (MP) 1,343/2026, which provides for fines of up to BRL 10 million per violation.
Judge Carlos Alberto Loverra, of the 1st Federal Court of São Bernardo do Campo (SP), found that the prior blocking mechanism for the CIOT (Transport Operation Identifier Code) constitutes an unconstitutional prior restraint on business activity without the due process guaranteed by the Federal Constitution.
This is the first court ruling to challenge the constitutionality of the enforcement mechanisms of MP 1,343/2026 on road cargo transportation, setting a relevant precedent for further actions in the logistics sector.
