Brazil’s Supreme Court resumes judgment on profit distribution by companies with tax debt

Brazil’s Supreme Court (STF) resumed, on June 19, 2026, in its Virtual Plenary, the judgment of ADI 5161, which addresses the constitutionality of fines imposed on companies that distribute profits or bonuses to partners and shareholders while holding unsecured tax debts with the federal government. Five justices have voted so far with no clear majority, and a final outcome was expected by June 26, 2026.
